The former personal attorney for Donald Trump has resigned as New Jersey's top federal prosecutor. This decision was prompted by a court battle that questioned her right to serve.
Official Departure
US Attorney General, Pam Bondi, announced her stepping down on Monday. She commented that the appeals court finding made it impossible for the official to effectively run her office.
"But do not mistake adherence to the ruling as defeat," she declared. "My fight will now extend throughout the nation."
Court Ruling
Habba's exit was triggered by a federal appellate panel determined that she had been acting without proper authority as US attorney. This decision is expected to impact numerous prosecutions in the Garden State.
The appellate judges declared that a temporary posting that did not receive the advice and consent of the Senate breached the Federal Vacancies Reform Act.
Next Steps and Responses
It was also stated that she will stay on at the DOJ as a high-level advisor. They intend to pursue additional appeals of the court's action, in the hope of achieving a different outcome.
In a statement, she wrote that the judiciary "should not be able to override the appointment of lawyers tasked with carrying out the executive branch's core responsibility of prosecuting crime."
Performance in Office
The attorney general praised Habba's record and noted that under her leadership, the Newark saw a one-fifth decrease in crime. She also stated that the Camden experienced its first summer in half a century free from homicides.
Background and Previous Role
The 41-year-old attorney, was initially recruited to Donald Trump's lawyers in recent years. She later defended her client in his hush-money trial in New York last year, which resulted in his conviction on 34 counts of falsifying business records.
Prior to Habba took on the top New Jersey post, Trump had revealed he was naming her as his presidential counsellor during his second administration, calling the lawyer as "unwavering in her loyalty" and a relentless legal advocate.
